Terms of service
Effective date: September 2, 2026. This version replaces all earlier Terms of Service.
Welcome to SafeHaven Luxury Smoke ("SafeHaven," "we," "us," or "our"). We run a smoke shop and VIP lounge at 297 Sharon Rd, Suite 108, York, SC 29745, and the online store at safehavenluxurysmoke.com (together, the "Services"). These Terms of Service (the "Terms") are the agreement between you and us whenever you browse the site, place an order, create an account, join our rewards or VIP programs, or shop with us in person.
The short version: our products are for adults 21 and over, we verify age for real, and we expect the person on the order to be the person with the ID. The rest of this page spells that out, along with the ordinary legal terms that govern any store. If you do not agree with these Terms, please do not use the Services.
1. Who can use the Services
- You must be at least 21 years old to purchase from SafeHaven, online or in store. This applies to every age-restricted product we carry — tobacco, nicotine and vapor products, hemp-derived THC, kratom, amanita mushroom products, and related consumables — and we apply it to purchases storewide.
- VIP Lounge entry is 18+ with a valid ID; purchase of age-restricted products in the lounge remains 21+.
- A valid, unexpired, government-issued photo ID is required for every in-store purchase of age-restricted products, and for every pickup and delivery release — where the name on the ID must also match the name on the order.
- By using the Services you represent that you meet these requirements and that all information you provide to us is accurate.
2. Age and identity verification
We verify age at several points, and completing a purchase means you agree to all of them:
- Online attestation. Every online order requires you to confirm you are 21 or older before checkout. That confirmation is recorded on your order.
- ID verification for regulated products. Orders containing age-regulated products require verification against a government-issued ID before checkout. Our verification reads the barcode on your ID on your own device; the barcode's text is transmitted to us, your date of birth and name are read from it to confirm your age, and the transmitted data is then discarded. We do not collect, view, or store images of your ID. How we handle personal information is described in our Privacy Policy.
- Verified profiles. If you have an account and the last name on your ID matches your account, your date of birth and verification status are saved to your profile, and you will not be asked to verify again for online checkout — pickup and delivery still require a physical ID check every time. Guests without an account verify each session.
- Verified profile fields are locked. A date of birth established by ID verification can only be changed by another successful ID verification, or as required by law. It cannot be edited by you or by customer request.
- Pickup and delivery checks. At pickup or delivery we physically check a valid government-issued photo ID, and the name on the ID must match the name on the order. If the ID does not match, is expired, or shows the recipient is under 21, the order will not be released; it will be cancelled and refunded to your original payment method.
- Our right to refuse. We may decline, hold, or cancel any order when verification fails, when we suspect a purchase is on behalf of someone under 21, or when we believe a purchase is otherwise unlawful. Buying age-restricted products for anyone under 21 is prohibited, and we report unlawful purchases where required.
3. Products
- We sell tobacco and nicotine products, vapor devices and e-liquids, hemp-derived cannabinoid products, kratom, amanita mushroom products, other botanical products, glass, and smoking accessories, among other merchandise. All products are subject to availability, and we may limit quantities or discontinue any product at any time.
- Product descriptions are provided for general information. No statement on the Services is medical advice, and our products are not intended to diagnose, treat, cure, or prevent any disease or condition. Statements about hemp, kratom, amanita, and botanical products have not been evaluated by the Food and Drug Administration.
- We work to keep listings accurate, but errors happen. We reserve the right to correct errors in descriptions, images, and pricing, and to cancel orders affected by them.
4. Product-specific terms and assumption of risk
By purchasing the product categories below, you acknowledge and accept the following:
- Hemp-derived cannabinoid products (including delta-8, delta-9, THC-A, THC-P, and similar) are sold as hemp-derived products; we source from suppliers who certify compliance with the 2018 Farm Bill's 0.3% delta-9 THC limit. These products may cause intoxication or impairment. Do not drive or operate machinery after use. Do not use if you are pregnant or nursing. Use of these products may result in a positive drug test. The legal status of hemp-derived cannabinoids varies by state and locality and continues to evolve; by ordering for shipment you confirm they are lawful where you receive them.
- Amanita mushroom products (gummies, chocolates, shots, and similar) contain muscimol from Amanita muscaria and do not contain psilocybin or any other controlled substance. They are psychoactive and may cause intoxication, drowsiness, dizziness, nausea, or disorientation. Do not drive or operate machinery after use. Do not use if you are pregnant or nursing. Their legality varies by jurisdiction; do not order them for delivery to a place where they are prohibited.
- Nicotine products. Nicotine is an addictive chemical. Vapor products and e-liquids may contain nicotine.
- Kratom and botanical products are sold as botanical products only, without any claim as to effect. They are not FDA-approved for any use, may be habit-forming, and may cause impairment; do not use while pregnant or nursing, and do not combine with alcohol or medications. They are not legal in all jurisdictions.
- Batteries and heating devices. Lithium batteries and heating elements can be dangerous if misused. Follow the manufacturer's instructions; never use damaged batteries or leave charging devices unattended.
- Keep all products away from children and pets.
5. Ordering, pricing, and payment
- All prices are in U.S. dollars and exclude applicable taxes and shipping, which are shown at checkout.
- Placing an order is an offer to purchase; we accept it when we confirm fulfillment. We may refuse or cancel any order, including for suspected fraud, verification failure, pricing or listing errors, or quantity limits. If we cancel a paid order, we refund it to your original payment method.
- You represent that you are authorized to use your chosen payment method. Initiating a chargeback for a purchase you made and received, in place of using our Refund Policy, may result in loss of account, rewards, and purchasing privileges.
6. Shipping, pickup, and delivery
- Shipping is governed by our Shipping Policy. In short: tobacco and nicotine products are not shipped, and vaporizer devices, cartridges, and e-liquids of any kind — including hemp-derived — are not shipped; they are available for in-store purchase and local pickup only. Kratom and amanita products are likewise sold in store and for pickup. Eligible hemp-derived and other products ship only where lawful.
- You are responsible for knowing whether a product is lawful in your jurisdiction before ordering it for shipment or delivery. Orders to places where a product is prohibited may be cancelled.
- Pickup and delivery orders are released only to a person 21 or older whose valid photo ID matches the name on the order, as described in Section 2.
- Risk of loss passes to you when the carrier confirms delivery to the address you provided; we are not liable for loss or theft after confirmed delivery. Please double-check your shipping address.
7. Returns and refunds
Returns, exchanges, and refunds you initiate are governed by our Refund Policy. Consumables and opened products are generally not returnable for safety and hygiene reasons. In-store returns require the item, proof of purchase, and a valid government-issued ID. Orders we cancel — including for failed age verification — are refunded to your original payment method.
8. Accounts, rewards, and VIP membership
- You may create one account, with accurate information, and you are responsible for activity under it. Keep your credentials private and tell us promptly if you believe your account is compromised. We may suspend or close accounts that violate these Terms.
- Our rewards program lets you earn and redeem points on qualifying purchases. Points have no cash value, are not transferable, and expire or adjust per the program rules shown where you enroll. We may modify, suspend, or end the rewards program, and correct erroneously credited points, at any time.
- VIP memberships provide the benefits described at purchase. Memberships are personal to you, non-transferable, and subject to the eligibility and conduct rules in these Terms.
- The VIP Lounge is a smoking and vapor environment. By entering, you voluntarily accept exposure to secondhand smoke and vapor, and you agree to the lounge rules posted on site, which are part of these Terms. Lounge access may be refused or revoked for conduct that endangers or disrupts staff or guests.
9. Communications
If you opt in to email or text marketing, we (and providers acting for us) may send you promotional messages; message and data rates may apply to texts, and you can opt out at any time via the unsubscribe link or by replying STOP. Transactional messages about your orders and account are sent regardless of marketing preferences. How we handle your information is described in our Privacy Policy.
10. Acceptable use and intellectual property
- You agree not to use the Services to violate any law; to misrepresent your age or identity or assist anyone else in doing so; to probe, disrupt, or overload the site or its verification systems; to scrape or harvest data; or to attempt unauthorized access to any system or account.
- All content on the Services — text, images, logos, graphics, and design — belongs to SafeHaven or its licensors and is protected by copyright, trademark, and other laws. You may not reuse it without our written permission.
11. Third-party services
The Services link to and rely on third-party services (for example payment processors, shipping carriers, and messaging platforms). Those services have their own terms and privacy practices, which we do not control and are not responsible for.
12. Disclaimer of warranties
The Services and all products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Manufacturer warranties, where offered, are between you and the manufacturer.
13. Limitation of liability
To the fullest extent permitted by law, SafeHaven and its owners, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the Services or products, and our total liability for any claim will not exceed the amount you paid us for the product or service giving rise to the claim. Nothing in these Terms limits liability for death or personal injury, or any other liability, to the extent such a limitation is prohibited by applicable law. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless SafeHaven and its owners, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your violation of law — including misrepresenting your age or purchasing for someone under 21 — or your misuse of the Services or products.
15. Governing law and dispute resolution
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules, and the Federal Arbitration Act governs this Section 15.
- Talk to us first. Before starting any formal proceeding, you agree to email support@safehavenluxurysmoke.com describing the dispute and give us 30 days to resolve it with you. Most problems end here, and we'd rather fix yours than fight about it.
- Binding arbitration. Except as provided below, any dispute arising out of or relating to these Terms, the Services, or any product — whether based in contract, tort, statute, or otherwise — will be resolved by final, binding arbitration before a single arbitrator, administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be held in York County, South Carolina, or remotely by agreement, and fees will be allocated as those Rules provide. This obligation is mutual: it binds us the same way it binds you. By agreeing to arbitration, both parties give up the right to sue in court and to a trial by jury for covered disputes.
- Individual claims only. Both parties waive the right to participate in any class, collective, consolidated, or representative action. The arbitrator may award relief only to the individual party and only as needed to resolve that party's claim. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) proceeds in court, and the rest remain in arbitration.
- What stays out of arbitration. Either party may bring an eligible claim in small-claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property or unauthorized access to the Services.
- Your right to opt out. You may reject this arbitration agreement, with no effect on any other part of these Terms, by emailing support@safehavenluxurysmoke.com within 30 days of first accepting these Terms, with your name and a statement that you opt out of arbitration.
- Court proceedings. Any dispute not subject to arbitration will be resolved exclusively in the state or federal courts located in or serving York County, South Carolina, and you consent to their jurisdiction.
16. General terms
- Changes. We may update these Terms from time to time. The current version is always posted here with its effective date, and changes apply prospectively from that date. For material changes we will provide notice — by email to account holders, a notice on the site, or both — and your continued use of the Services after notice means you accept the updated Terms.
- Severability. If any provision of these Terms is found unenforceable, the rest remain in effect.
- No waiver. Our not enforcing a provision is not a waiver of it.
- Assignment. You may not assign these Terms; we may assign them in connection with a sale or reorganization of the business.
- Entire agreement. These Terms, together with the policies linked in them, are the entire agreement between you and us about the Services.
